Einstein’s razor, a corollary of Ockham’s razor, is often paraphrased as follows: make everything as simple as possible, but not simpler. This rule of thumb describes the challenge that designers of a legal system face—to craft simple laws that produce desired ends, but not to pursue simplicity so far as to undermine those ends. Complexity, simplicity’s inverse, taxes cognition and increases the likelihood of suboptimal decisions. In addition, unnecessary legal complexity can drive a misallocation of human capital toward comprehending and (...) complying with legal rules and away from other productive ends. While many scholars have offered descriptive accounts or theoretical models of legal complexity, most empirical research to date has been limited to simple measures of size, such as the number of pages in a bill. No extant research rigorously applies a meaningful model to real data. As a consequence, we have no reliable means to determine whether a new bill, regulation, order, or precedent substantially effects legal complexity. In this paper, we begin to address this need by developing a proposed empirical framework for measuring relative legal complexity. This framework is based on “knowledge acquisition”, an approach at the intersection of psychology and computer science, which can take into account the structure, language, and interdependence of law. We then demonstrate the descriptive value of this framework by applying it to the U.S. Code’s Titles, scoring and ranking them by their relative complexity. We measure various features of a title including its structural size, the net flow of its intra-title citations and its linguistic entropy. Our framework is flexible, intuitive, and transparent, and we offer this approach as a first step in developing a practical methodology for assessing legal complexity. (shrink)

The current model of technology assessment treats ethics itself as just another problem‐solving technology. Ethics should resist this model to play a more critical role in technology assessment by better understanding the complex relationship between society, medicine, and technology—and by recasting how problems are defined.

Gerhard Ebeling on faith. Gerhard Ebeling (1912–2001), not only the foremost Luther researcher of the previous century but also one of the most prominent contributors to protestant theology during that period, wrote extensively about faith throughout his long and productive life as a professional theologian. He learnt from Luther that discerning judgement in the differentiation of related matters forms the basis of all sound theology. Applying this insight to his own thought, he reflects on the development of the phenomenon of (...) faith in the Old Testament community and early Christianity and the formalisation of the concept for use in the domain of religious studies. He defends the argument that Christian faith is not only faith in Jesus as the Christ and Lord but also that Jesus, and He only, is the founder and perfecter of faith. The concept of faith is also explored by Ebeling in relation to love, life and reason. The article concludes with a critical evaluation of Ebeling’s contribution in guiding us to witness authentically about our own faith in Jesus Christ within our own situation and against the background of the problems it poses for believing in Christ. It is suggested that consciousness is primarily associated not with stimuli and perception, as commonly supposed, but with movement and responses. Consciousness of stimuli arises in situations in which possible movements are planned, or in which information must be actively acquired rather than passively registered, and may or may not require overt movements to be performed. By emphasizing response, this formulation provides a simple explanation for the perceived unity of consciousness: though stimuli can be diverse, with independent components, movements must (...) necessarily be coordinated. Therefore, if we are to look for a `site' for consciousness, it is likely to be in a region such as the anterior cingulate that is neurally close to the higher motor hierarchical levels, and also accessible both to real sensory feedback and also to virtual feedback derived through mechanisms of efference copy from actual or proposed motor commands. It is suggested that synchrony of arrival of such information may be an important prerequisite of this unity, and that on this basis such a `master node' might be expected to be temporally `equidistant' from each of these sources; this may well be true of the anterior cingulate, but no doubt also of other structures. The first brief description is given of a project aimed at searching for the neural correlates of consciousness through computer simulation. The underlying model is based on the known circuitry of the mammalian nervous system, the neuronal groups of which are approximated as binary composite units. The simulated nervous system includes just two senses - hearing and touch - and it drives a set of muscles that serve vocalisation, feeding and bladder control. These functions were chosen because of their relevance (...) to the earliest stages of human life, and the simulation has been given the name CyberChild. The system's pain receptors respond to a sufficiently low milk level in the stomach, if there is simultaneously a low level of blood sugar, and also to a full bladder and an unchanged diaper. It is believed that it may be possible to infer the presence of consciousness in the simulation through observations of CyberChild's behaviour, and from the monitoring of its ability to ontogenetically acquire novel reflexes. The author has suggested that this ability is the crucial evolutionary advantage of possessing consciousness. The project is still in its very early stages, and although no suggestion of consciousness has yet emerged, there appears to be no fundamental reason why consciousness could not ultimately develop and be observed. Health care reform poses numerous challenges. A core challenge is to make health care more efficient and effective without causing more harm than benefit. Additionally, those fashioning health-care policy must encourage patients to exercise caution and restraint when expending scarce resources; restrict the ability of politicians to advance their careers by promising alluring but costly entitlements, many of which they will not be able to deliver; face the demographic challenges of an aging population; and avoid regulations that create significant inefficiencies (...) and restrict access to health care. Given such real-world challenges, how should health care be reformed in the United States or elsewhere? This number of The Journal of Medicine and Philosophy examines many of the complex issues that must be considered in reforming a health-care system. (shrink)

The paper introduces a first-order theory in the language of predicate tense logic which contains a single simple axiom. It is shewn that this theory enables times to be referred to and sentences involving ‘now’ and ‘then’ to be formalised. The paper then compares this way of increasing the expressive capacity of predicate tense logic with other mechanisms, and indicates how to generalise the results to other modal and tense systems.

Africa’s current socio-economic predicament is often solely attributed to political and economic mismanagement. However, such an analysis is far from comprehensive, as it fails to account for the historical, sociological and psychological causes of the current unsatisfactory social conditions in the continent. Consequently, using the critical and prescriptive techniques of philosophic reflection, this paper examines four apparent mental impediments to desirable social transformation in contemporaryAfrica, namely, conservatism, feeble social consciousness, blind acceptance of the white-black dichotomy, and a fixation with foreign (...) paradigms of managing public affairs. The paper calls for an interdisciplinary approach to the verifying, mitigating and/or eliminating of these impediments. (shrink)

The issue of energy and its potential localizability in general relativity has challenged physicists for more than a century. Many non-invariant measures were proposed over the years but an invariant measure was never found. We discovered the invariant localized energy measure by expanding the domain of investigation from space to spacetime. We note from relativity that the finiteness of the velocity of propagation of interactions necessarily induces indefiniteness in measurements. This is because the elements of actual physical systems being measured (...) as well as their detectors are characterized by entire four-velocity fields, which necessarily leads to information from a measured system being processed by the detector in a spread of time. General relativity adds additional indefiniteness because of the variation in proper time between elements. The uncertainty is encapsulated in a generalized uncertainty principle, in parallel with that of Heisenberg, which incorporates the localized contribution of gravity to energy. This naturally leads to a generalized uncertainty principle for momentum as well. These generalized forms and the gravitational contribution to localized energy would be expected to be of particular importance in the regimes of ultra-strong gravitational fields. We contrast our invariant spacetime energy measure with the standard 3-space energy measure which is familiar from special relativity, appreciating why general relativity demands a measure in spacetime as opposed to 3-space. We illustrate the misconceptions by certain authors of our approach. (shrink)

This text is an innovative exploration of philosophy and madness in the context of the critical engagement of Heidegger’s phenomenological ontology with Freudian psychoanalysis. Included is a play in which, after a mental breakdown, Martin Heidegger undergoes psychoanalytic treatment from Dr. Medard Boss. Boss is essentially caught between two intellectual giants: his patient, Heidegger, who challenges him to evolve beyond traditional Freudian psychoanalysis, and his mentor, Freud, who acts as a “ghostly” consultant in facilitating Heidegger’s return to health. The dialogue (...) of the play consists of actual quotes taken from the major thinkers themselves, which enhances the authenticity of this fictitious production. In addition, the theoretical perspectives of Freud, Heidegger, Boss, and Ludwig Binswanger are included to enhance the readers’ background knowledge. In the process of disclosing these brilliant theorists, this book uncovers what each orientation has to offer the others. (shrink)
